What has changed is the definition of the consumer class in the water pump lawsuit that was certified as a class action in June 2021. The original class included any Ford customer whose vehicle had a water pump failure on or before June 8, 2021.
The water pump class action lawsuit now includes:
“All persons and corporations in Canada, other than Excluded Persons, who owned or leased one of these vehicles on or before May 30, 2024, when its water pump failed and: (a) the vehicle was damaged; or, (b) the vehicle was damaged and a Class Member suffered a personal injury.”
This means that if the water pump fails, it is bound to cause damage to the Ford vehicle as well. In addition, if the car is damaged and the customer is injured, the customer is covered as well.
The Ford water pump class action lawsuit was filed by Kimberley Carter, Keith Halliday and Deonarine Phagoo, all of whom believe that defective water pumps can cause catastrophic engine failures.
The plaintiffs claimed that the vehicle’s engine was damaged when the water pump leaked coolant into engine components, but Ford denied that there was any problem with the water pump or the vehicle.
According to the Ford Canada class action lawsuit, customers of the above vehicles are automatically included in the water pump class action lawsuit.
The Ford water pump class action lawsuit has been filed in the Ontario Superior Court of Justice in Canada: Carter et al. v. Ford Motor Company of Canada Ltd. et al..
The plaintiffs are represented by Koskie Minsky LLP.
