Ford believes hybrid engine class action lacks

Ford said “possible future harm” and “speculative fear” would not be endured in court.

– Ford’s hybrid engine issue caused two recalls, two customer satisfaction programs and class action lawsuits, which Ford believes should be dismissed entirely.

According to Ford, just like many vehicle recalls in recent years, the Ford hybrid engine recall has resulted in a separate class action lawsuit alleging “fraud.”

“And, like many such actions, alleged class representatives have not struggled to cope with the absurdity of their notion that auto companies deliberately hide a flaw that can lead to fires when the same company has to spend more money to resolve the factory’s fixed expected recall.” – Ford

In July 2022, Ford recalled the 2020-2022 Ford Escape Hybrid, 2021-2022 Lincoln Corsair Hybrid and 2022 Ford Maverick Maverick Hybrid vehicles, equipped with a 2.5L engine. Recalls were announced due to engine failure and fires involving engine blocks and oil pan holes.

A Ford hybrid lawsuit was filed for the first time a few weeks after the recall, but it was eventually dismissed because the hybrid was recalled for repairs.

However, Ford had to announce a second hybrid engine fire recall, which resulted in another class action lawsuit (Target v. Ford), the first case is retried by the judge.

In addition to the Ford Hybrid recall, the automaker has launched the Customer Satisfaction Program 23N06, which lasts no more than 100,000 miles or 10 years after the warranty start date, allowing for free one-time replacement of the long engine block.

Motion to dismiss Ford Hybrid Engine Fire Litigation

According to Ford, there is no better form of class action than the original dismissed. Ford pointed to two mixed owners of the prosecution, both for the 2021 Ford escaped and opened fire.

Ford said the two plaintiffs suggested, but did not claim to support the fire, with any connection to the recall-related flaws

Ford further argued that four hybrid owners purchased the vehicle after the hybrid was recollected repairs. Ford did not claim that the plaintiffs did not claim that their vehicles were stalled or on fire.

Instead, the plaintiffs said they were suffering from “attention”, “anxiousness” or lack of confidence. Everyone admits he has “disposed” his hybrid tool, but Ford argues that the allegations involve “probable future harm” or “speculative fear” but not harm to the harm.

The class action lawsuit claims that the Ford hybrid could “explode” due to engine issues, but Ford argued that almost all plaintiffs did not complain about connecting rod bearings, engine blocks that violated or even stalled engines.

“Instead, they emphasized their subjective belief that Ford’s remedies were based on their own personal concerns, anxiety and worries.” – Ford’s motion to fire

Ford claims that even among the few hybrid owners who claim their vehicles are stalled or enter li-line mode, the allegations do not contain facts to show that the problems are caused by hybrid engine defects.

The class action claims are allegedly “hypothetical” and are based on plaintiffs’ subjective fears as they may encounter problems in the future.

Ford references accused the hybrid owner of engine replacement, which the plaintiff called “appropriate remedy”, but the plaintiffs remained concerned about problems.

The Ford Hybrid Engine Fire Protection lawsuit was filed in the U.S. District Court for the Eastern District of Michigan: Anthony Pacheco v Ford Motor Company.

The plaintiffs are represented by Hagens Berman Sobol Shapiro LLP and Miller Law Firm PC.
