Ford Fusion Energi class action lawsuit filed in Canada

The Ford Canada lawsuit alleges that 2019-2020 Ford Fusion PHEVs may catch fire due to a defective battery.

Ford Canada recalled the vehicles in June 2023.

Like all hybrid vehicles, Fusion Energi cars can be driven without charging, but they will use more gas than when charged.

“This class action lawsuit involves the negligent and dangerous design, manufacture and installation of the high-voltage battery energy control module in 2019-2020 Ford Fusion PHEV vehicles.”

Ontario plaintiff Zachary Christou purchased a 2020 Ford Fusion SEL Hybrid in June 2022 to save money on gas.

The plaintiff said he spent $655.11 on gasoline in the 12 months before receiving the June 2023 recall notice. The plaintiff stated that over a period of nearly seven months, he spent $1,117.06 on gas.

According to the Ford Canada class action lawsuit, the Fusion Energi battery module could become damaged and prevent the car from starting, or the battery could overheat and cause a fire.

The plaintiffs allege at least seven car fires occurred, but Ford allegedly failed to warn customers about the problems.

In July 2022, Ford was informed of five alleged fires in the United States that occurred in the trunk area of ​​a 2019 Fusion hybrid equipped with a 30Ah high-voltage battery. The incidents occurred between March and May 2022. between. The supplier traced the fire to the battery.

Then in February 2023, Ford issued a technical service bulletin to dealers, telling technicians that if a Fusion Energi was brought in for service and certain diagnostic trouble codes were set, the battery would need to be replaced.

Ford is said to have a duty to Fusion Energi customers to ensure the vehicles are “fit for intended and/or reasonably foreseeable purposes.”

The plaintiffs believe Ford should pay:

“General and special damages in the amount of $20,000,000.00; punitive damages and/or aggregate damages in the amount of $1,000,000.00.”
