– Honda argues that the class action lawsuit filed with the Honda citizen owner dismissed a class action lawsuit filed by a Honda citizen owner who did not claim any problems with his vehicle should be enough for the judge to dismiss a class action lawsuit.
Shavonne Geddis-Wright, a citizen owner of Honda, South Carolina, filed a class action lawsuit, which included:
“All the U.S. people who purchase or lease any 2020-2021 Honda Civic, 2020-2023 Honda Ridgeline, 2021-2023 Honda Passport, 2021-2022 Honda Pilot and 2020 Acura MDX vehicles.”
Honda noted that the plaintiff filed nearly the same class action lawsuit in California and then dismissed it before the court ruled that Honda dismissed the motion.
The automaker filed a motion by dismissing the allegations in the lawsuit because the plaintiff and all affected customers were satisfied with the score’s Rod fastener recall, which was a waste of time.
Honda said the tie rod fastener recall “is completely relieved for the damage claimed by the plaintiff.”
In July 2023, Honda recalled 124,000 cars as the pull rod fasteners connecting the brake booster and large cylinders may relax. Honda told the government that it could affect about 1% of vehicles, but the problem could lead to the separation of the brake master cylinder from the booster assembly.
Honda said there are no crashes or injuries yet, but there are two warranty claims at the time of recall.
After the recall was announced, Shavonne Geddis-Wright purchased the 2020 Honda Civic in November 2020. She filed a Honda class action lawsuit for more than $5 million, but she did not claim that her vehicle had any problems with the brakes.
The class action lawsuit talks about the recall of Honda’s lever, which the plaintiff admitted: “Including a free repair and repair clause, the defendant will repair and replace the faulty parts….”
The plaintiff claimed to have taken her Honda Civic to a dealership, meaning that it was allegedly under the name of “delay or even death” and then she had to wait at least 30 minutes to complete the repair.
So while the plaintiff insisted that driving to a Honda dealer for free recall repairs was expensive and dangerous for the issue she sued, Honda thought all of this was “speculative and incredible.”
According to Honda, the plaintiff did not claim that her vehicle repaired her own vehicle under a tie-secured fixer recall, but she asserted that the recall was an “ineffective waste of time.”
She also complained that she had to drive 60 miles to a South Carolina dealership and had to wait at least 30 minutes to complete the repair.
“Although the plaintiff even claimed that she needed to tow the car to the dealership, she did not claim that her car had any problems. Finally, the plaintiff argued that she was burdened with the car for the devaluation of the defendant’s behavior. Honda
Honda also mentioned how the plaintiff complained that she would have to pay $285 for the vehicle to be towed to the dealership, but that was much less than the $405 she paid Tie Rod Rod Fastener class action lawsuit.
“These concerns about the ‘pain’ of pursuing the recall are not immediate threats or burdens, and this will justify hearing the case now.” – Honda
In Honda’s motion for dismissal, the automaker argued that the plaintiff “required the court to conduct a hypothetical transaction” because the lawsuit alleged that even if her vehicle never encountered any brake problems, the recall repairs would not work properly.
Honda said class action should not be held in court, at least until the plaintiff “uses the remedies provided in the recall.”
Honda also told the judge that the plaintiff’s Magnuson-MOSS warranty claim must be dismissed because the bill only allows class action claims when there are only 100 or more named plaintiffs. But in this case, there is only one named Plaintiff.
The Honda League Rod Fastener recall class action lawsuit was filed in the U.S. District Court for the District of South Carolina (Orangeburg Division): Shavonne Geddis-Wright v. American Honda Motor Company, Inc.
Plaintiffs are represented by Poulin | Willy | Anastopoulo.
