Jaguar I-Pace battery recall lawsuit continues

The lawsuit filed after Jaguar recalls the 2019-2024 Jaguar I-Pace SUV to resolve battery issues. The May 2023 Jaguar I-Pace battery recall was triggered by a possible battery fire after the automaker investigated the battery problem.

According to the recall of Jaguar I-Pace battery, the vehicle may experience thermal overload, which may show up as smoke or fire under the I-Pace where the high-voltage traction battery is located.

Jaguar mailed an I-Pace battery recall letter in July 2023 so dealers can update the battery energy control module software. The dealer is also told to check the battery and determine if the battery module should be replaced.

The recall file submitted to the government says the software update will monitor the components of the battery pack in case the battery contains conditions that may cause thermal overload conditions. If a battery problem is detected, the battery charging capacity will be limited to 75%.

The judge in Jaguar noted that this was a motion to dismiss the lawsuit, so the court “must treat all charges as true.” He went on to say that he “must accept all the major allegations brought in the complaint and that these facts must be explained in support of (the plaintiff).

The judge deemed the charges true, ruling that the plaintiff reasonably pointed out that the Jaguar I-Pace SUV was less valuable than the battery problem, and that “the warranty did not fix the problem.”

The recall failed to repair the SUV and the owner cannot rely on the warranty, according to the class action lawsuit.

The judge ruled that Jaguar had a written warranty obligation but failed to fulfill their responsibilities because the plaintiff said the battery was still defective.

The judge said the allegations in the class action lawsuit were that Jaguar’s battery recall and repair attempts failed and the owner suffered financial harm. According to the judge, “from the perspective of the plaintiffs’ best favor”, they may have claimed to have committed financial harm.
