Mazda sued over heated seats

September 17, 2024 — A California Mazda class-action lawsuit alleges that 2018 Mazda6 vehicles are equipped with dangerous heated seats.

The class action lawsuits include:

“To the maximum period permitted by law, all citizens of the State of California who reside in the State of California and who purchased the vehicle from the defendant.”

However, the lawsuit also states that all other Mazda models equipped with the same seat heating system as the 2018 Mazda6 are included in the class action lawsuit. However, the suing car owner did not specify which Mazda models were involved.

The Mazda seat heater lawsuit was filed by California plaintiff Kristine Dyvad, who claims to have “severe burns and scarring resulting from the use of defective seat heaters in her Mazda vehicle.”

The class action lawsuit alleges that Mazda has received multiple reports of dangerous defects, but the plaintiffs do not allege the specific defects. The plaintiffs also do not say how the accidents occurred.

However, the plaintiff claims that if Mazda had warned her about the issues with the heated seats, she would not have purchased the Mazda 6, or would have paid significantly less.

Mazda allegedly knew all along about the defect in the seat heaters but failed to warn consumers.

Thousands of California consumers were allegedly exposed to dangerous Mazda vehicles and “suffer injuries resulting from the purchase and use of Mazda vehicles.”

The Mazda class action lawsuit claims that Mazda’s failure to disclose the heated seat issues caused the vehicles to be less valuable to consumers.

As for the California statute of limitations:

“Because Defendants actively concealed vehicle defects and/or failed to inform Plaintiff of vehicle defects, all applicable statutes of limitations applicable to the allegations herein are suspended.”

The Mazda heated seat class action lawsuit has been filed in the Superior Court of San Francisco County, California: Kristine Dyvad v. Mazda Motor Corporation of America et al..
