At the time, Mercedes told the owner not to drive before checking the brake booster. The problem is caused by moisture and can cause corrosion in the brake booster box. Moisture under the brake assist rubber sleeve installed around the brake assist booster.
Mercedes said it knew there was no crash or injury, but owners should park the vehicle until the dealer removes the rubber sleeve to check the brake booster.
Recall files according to brake booster:
“Authorized Mercedes-Benz dealerships will remove rubber sleeves from the brake booster housing, inspect brake boosters on the affected vehicle and replace them as needed depending on the results of this inspection. Affected customers will be mailed to the recall owner notification letter and directed to stop driving the vehicle until you need to drive, and you can drive until you need to pay. Provide a personal solution for the customer, including alternative mobility.” – Mercedes Benz
Mercedes also said it will pay for all towing costs related to the brake booster recall and will pay back customers who paid for previous brake booster repairs.
Additionally, Mercedes offers free lending vehicles, but if not available, “other solutions will be provided such as taxi/travel, public transport fee repayment and rental reimbursement.”
The automaker also said that if the Mercedes owner is in an area where a mobile inspection can be performed, it may not need to tow.
Mercedes-Benz Brake Assistance Litigation-Plaintiff
Washington’s plaintiff Javad Maadanian owns the 2011 Mercedes-Benz ML 350, which was recalled for brake assist issues. The class action lawsuit alleges that the plaintiff stopped driving the vehicle as directed and contacted the local Mercedes dealership.
The plaintiff said he asked to tow to the dealer and asked to use a loan car. If it is impossible, he demands compensation for towing and rental cars. He asserted that he was rejected.
The Mercedes Brake Booster Recall was announced in May 2022 and was told in late July 2022 or early August 2022 that Mercedes-Benz will reimburse him $800 for out-of-pocket expenses.
According to the lawsuit, the compensation covers only a small percentage of the plaintiff’s expenses related to the brake booster recall and “there is no indication that the compensation provided… is actually paid.”
Although the National Highway Traffic Safety Administration approved and monitored the brake booster recall, the class action lawsuit alleges that Mercedes-Benz “unfairly forcing consumers to bear the burden and cost of repair or replacement through a flawed and inadequate recall program.”
Mercedes brake booster recall compensation lawsuit continues
According to the class action, Mercedes “illegally transferred the fees for repairs or replacements to the plaintiffs and all customers who recalled the vehicle.
Judge Robert S. Lasnik said that even without deceptiveness, “unfair conduct or practice” that violates the public interest can form the basis of consumer protection requirements.
Therefore, the judge ruled that the lawsuit “can proceed against allegations that the defendant unfairly transfers repair and replacement costs to consumers.”
