On May 30, 2024, Electrolux Consumer Products, Inc. (“Electrolux”) (“Petitioner”) filed a petition to impose antidumping duties on imports from the Kingdom of Thailand (“Thailand”). Electrolux alleges that producers and exporters in Thailand are selling goods at less than fair value. If Electrolux successfully proves that the unfairly priced imports are causing material injury to the domestic industry, the U.S. government will impose antidumping duties to offset the level of unfair pricing found. Parties adversely affected by this case should consider participating early as it is pending before the U.S. Department of Commerce and the U.S. International Trade Commission. We provide more details on the allegations made in the petition and the case timeline below.
Scope of investigation
The following language describes goods imported from Thailand that fall within the scope of this petition:
The products covered by this petition are large top-loading combination refrigerator-freezers with a refrigerated capacity of at least 15.6 cubic feet or 442 liters. For purposes of this petition, a “large top-loading combination refrigerator-freezer” is a freestanding or built-in cabinet that uses compression technology and has all of the following characteristics:
- The cabinet contains at least two internal storage compartments accessible by one or more separate exterior doors or drawers or a combination thereof;
- the lowest interior storage compartment accessible by an exterior door or drawer is a refrigerator or fresh food compartment but not a freezer compartment, however, the presence of an interior subcompartment in the lowest storage compartment for ice making does not make the lowest storage compartment a freezer compartment; and
- There is a freezer compartment mounted above the lowermost interior storage compartment.
For purposes of the petition, a refrigerator is capable of storing food at temperatures above 32 degrees Fahrenheit (0 degrees Celsius), and a freezer is capable of storing food at temperatures at or below 32 degrees Fahrenheit (0 degrees Celsius).
The products covered by this application are currently classified under subheading 8418.10.0075 of the Harmonized Tariff Schedule of the United States (HTSUS). The products covered by this application may also be classified under HTSUS subheadings 8418.21.0090, 8418.40.0000, 8418.99.4000, 8418.99.8050, and 8418.99.8060. The HTSUS subheadings are provided for convenience and customs purposes, but the written description of the goods falling within this scope is decisive.
