— A Toyota Tacoma transmission class action lawsuit has been filed four days after Toyota announced it would replace the transmission and torque converter on 2024 models for free.
The lawsuit covers 2024 or newer Toyota Tacoma trucks equipped with an 8-speed automatic transmission or an 8-speed automatic hybrid transmission.
According to the class action lawsuit, the Toyota Tacoma transmission failed to shift, engaged violently, went into limp mode, and suffered transmission damage that caused the Tacoma’s transmission failure.
The class action lawsuit was filed days after Toyota announced free replacement of the Toyota Tacoma T-SB-0076-24 automatic transmission and torque converter. But the truck owner who filed the lawsuit claimed there was no point in replacing the transmission because the replacement transmission was just as defective as the original transmission.
California plaintiff Abdul Syed, who owns a 2024 Toyota Tacoma, said the vehicle developed transmission problems shortly after purchasing it. The plaintiff said his truck “experienced violent downshifts and violent vibrations between gears.”
“When accelerating from a stop, there was noticeable acceleration lag, harsh drive gear engagement, and a jerky feeling, as if the vehicle had unexpectedly jerked forward.” — Toyota Tacoma Transmission Lawsuit
The plaintiff argued that the transmission “continued to exhibit further problems, including sudden, forceful gear engagement, jerking, tilting and delayed acceleration.”
Although he filed a class-action lawsuit worth more than $5 million and claimed that the transmission issues put him at “an increased risk of serious injury or death,” he did not claim that he had the Tacoma inspected by the dealer or any mechanic.
The plaintiff also mentions the Toyota Tacoma T-SB-0076-24 free transmission replacement program in the lawsuit, but claims his “2024 Tacoma is not subject to any technical service bulletin, special service event or transmission defect recall.” constraint”.
According to the class action lawsuit, 2024 Toyota Tacoma trucks equipped with Aisin Toyota AL80E, AL80F or L580F 8-speed automatic transmissions are defective.
In July, Toyota released technical note T-TT-0758-24 to dealers for the 2024 Tacoma truck, titled “Torque converter required during transmission replacement with debris.”
“When replacing a transmission, if debris is found in the pan, the torque converter will need to be replaced at the same time. If the torque converter is not replaced, remaining debris may be introduced into the replacement transmission… Use the appropriate service manual for replacement Torque Converters and Transmissions” — Tech Tip T-TT-0758-24
The plaintiffs argue that Toyota knew about the 2024 Tacoma transmission defect in 2016 but “actively concealed and continues to conceal the true nature and extent of the transmission problem.”
As stated in every auto class action lawsuit:
“Had Plaintiffs and other class members known about the transmission defects, they would not have purchased or leased class vehicles or would have paid significantly less.”
The Tacoma transmission lawsuit also accuses the owners of the 2024 trucks of “(1) out-of-pocket costs to repair transmission defects; (2) costs of future repairs or replacements; (3) selling the vehicles at a loss; and (4) selling the vehicles.” (4) a decrease in the value of its vehicles; and/or (5) a price premium due to the purported safety and reliability of such vehicles. “
